Masters of Mayhem Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Masters of Mayhem, including the Masters of Mayhem website, game, related online services, community features, accounts, content, software, and any other services that link to these Terms (collectively, the “Services”).

The Services are operated by Super Studios, Inc. (“Super Studios,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using the Services, creating or using an account, launching or playing the game, or clicking to accept these Terms, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Privacy Policy

Please review our Privacy Policy, which explains how we collect, use, disclose, and protect personal information when you use the Services.

By using the Services, you acknowledge that you have read and understand the Privacy Policy.

2. Eligibility and Age Requirements

You must be at least 13 years old to create an account, access, or play Masters of Mayhem.

We may ask for your date of birth or other age-related information before allowing access to the Services. If you indicate that you are under 13 years old, you will not be permitted to create an account, access, or play Masters of Mayhem.

You agree that any information you provide to us, including age-related information, will be accurate and complete.

If we learn that a user under 13 has accessed the Services or provided personal information, we may suspend or terminate access and take steps to delete the information as required by applicable law.

If you are under the age of majority in your jurisdiction but at least 13 years old, you may use the Services only with the involvement and consent of a parent or legal guardian.

3. Account Access and Steam Authentication

Masters of Mayhem currently uses Steam authentication to support account access and gameplay.

When you authenticate through Steam, we may create an internal Super Studios account or user ID for the game and link it to your Steam ID. This allows us to support gameplay, progression, account management, moderation, and possible future platform integrations.

You are responsible for maintaining the security of your Steam account and any other account credentials used to access the Services.

We are not responsible for any loss or damage arising from unauthorized access to your Steam account or other third-party accounts.

4. Game Access and Changes to the Services

We may update, modify, suspend, or discontinue all or part of the Services at any time, including game features, characters, items, modes, rewards, online services, community features, and account functionality.

We may also impose limits on certain features or restrict access to all or part of the Services without notice or liability where reasonably necessary for security, legal compliance, moderation, operational, or business reasons.

The Services may be unavailable from time to time due to maintenance, updates, technical issues, or circumstances beyond our control.

5. User Conduct

You agree not to do any of the following while using the Services:

• harass, threaten, abuse, bully, stalk, or intimidate others;
• use hate speech, slurs, discriminatory language, or targeted abuse;
• post, transmit, or share sexual content, especially content involving minors;
• groom, exploit, manipulate, or attempt to harm minors;
• share or request personal information such as real names, ages, addresses, locations, phone numbers, financial information, passwords, private contact information, or anything personally identifying;
• impersonate another person or misrepresent your identity;
• cheat, exploit bugs, use unauthorized software, bots, macros, hacks, automation, or other unfair advantages;
• interfere with the operation, security, or integrity of the Services;
• reverse engineer, decompile, disassemble, or attempt to derive source code from the Services except where permitted by law;
• upload, transmit, or distribute viruses, malware, scams, phishing links, malicious links, or harmful code;
• spam, flood, scam, phish, advertise, self-promote, solicit, or disrupt the Services or community spaces without permission;
• post or share NSFW content, gore, pirated content, illegal content, or suspicious content;
• discuss or promote illegal activity;
• violate any applicable law or regulation;
• infringe or violate intellectual property, privacy, publicity, or other rights of others;
• bypass age gates, access controls, suspensions, bans, or moderation systems;
• encourage or help anyone else do any of the above.

6. Chat, Voice, Community Features, and Moderation

The Services may include text chat, voice chat, player reporting, moderation systems, Discord, community features, or other interactive features.

You are responsible for your communications and conduct when using these features.

We may monitor, review, record, store, moderate, remove, restrict, or disable access to content, communications, accounts, or features where we believe it is necessary or appropriate to:

• operate and protect the Services;
• enforce these Terms or our Community Guidelines;
• investigate abuse, harassment, cheating, safety concerns, or illegal conduct;
• protect users, minors, Super Studios, or others;
• comply with legal obligations or law enforcement requests.

We are not obligated to monitor all activity or content, but we reserve the right to do so.

We may use automated tools, including AI-assisted systems, filters, and detection tools, to help identify abusive, unsafe, harmful, or policy-violating content or behavior.

7. Community Guidelines

You must follow our Community Guidelines and any posted rules that apply to Masters of Mayhem, including rules posted in our Discord server, website, game, or other official community spaces.

The Community Guidelines apply to:

• in-game text chat;
• in-game voice chat;
• Discord;
• support interactions;
• official community spaces;
• future community or social features.

The Community Guidelines are published by Super Studios and updated from time to time, and our current Discord server rules may serve as part of the Community Guidelines. We may update, replace, expand, or relocate the Community Guidelines at any time.

If there is a conflict between these Terms and the Community Guidelines, these Terms control.

8. Enforcement

If we believe you have violated these Terms, our Community Guidelines, platform rules, or applicable law, we may take action, including:

• issuing a warning;
• muting or restricting communication features;
• removing content;
• suspending access;
• permanently banning an account;
• restricting gameplay or community features;
• reporting conduct to law enforcement where appropriate;
• taking any other action we reasonably believe is necessary.

We may take these actions with or without notice, depending on the circumstances.

9. User Content and Feedback

The Services may allow you to submit or transmit content, including chat messages, reports, usernames, feedback, comments, screenshots, support requests, or other materials (“User Content”).

You retain any rights you may have in your User Content. However, by submitting User Content, you grant Super Studios a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, display, distribute, use, and otherwise process your User Content for purposes of operating, improving, moderating, promoting, and protecting the Services.

If you submit feedback, ideas, suggestions, or proposals, you agree that we may use them without restriction or compensation to you.

You represent that you have the rights necessary to submit your User Content and that your User Content does not violate these Terms or applicable law.

10. Intellectual Property

The Services, including the game, software, characters, artwork, names, logos, designs, gameplay systems, audiovisual content, text, graphics, code, and other materials, are owned by Super Studios or its licensors and are protected by intellectual property laws.

Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works based on the Services.

Subject to your compliance with these Terms, Super Studios grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, non-commercial entertainment purposes.

11. Blockchain, Wallets, and Digital Assets

The Services may allow optional interactions with blockchain-related functionality through our website or other approved systems, such as linking a wallet or verifying ownership of certain digital assets or NFTs for in-game functionality.

Unless we clearly state otherwise, wallet linking is optional and is not required to play the game.

Blockchain networks, wallets, marketplaces, and related services are operated by third parties and are not controlled by Super Studios. We are not responsible for third-party blockchain networks, wallet providers, marketplaces, transaction fees, failed transactions, lost assets, wallet compromises, or changes to blockchain protocols.

Ownership of an NFT or digital asset does not guarantee permanent access to any specific game feature, character, benefit, utility, or service. Game features and supported integrations may change over time.

You are solely responsible for the security of your wallet, private keys, seed phrases, and digital assets.

12. Purchases and Payments

The Services may include paid features, downloadable content, digital items, or other purchases in the future.

Payments may be processed by third-party platforms or payment processors, including Steam or other authorized providers. We do not currently intend to directly collect or store credit card information for in-game purchases.

All purchases are subject to any additional terms presented at the time of purchase and any applicable platform terms.

Except where required by law or expressly stated otherwise, purchases are final and non-refundable.

13. Third-Party Services

The Services may integrate with or link to third-party services, including Steam, Discord, wallet providers, analytics providers, cloud service providers, voice chat providers, support tools, or other services.

Your use of third-party services may be subject to separate terms and privacy policies. We are not responsible for third-party services, and your use of them is at your own risk.

14. Updates, Testing, and Beta Features

The Services may include beta, test, early access, experimental, or unfinished features.

These features may be unstable, incomplete, or changed or removed at any time.

You understand that game progress, accounts, rankings, items, rewards, or other data may be reset, modified, or deleted during testing or as part of game operations.

15. Termination

You may stop using the Services at any time.

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms, created risk for Super Studios or others, or if continued access is no longer commercially, technically, legally, or operationally practical.

Upon termination, the rights granted to you under these Terms will end immediately.

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, user content, disclaimers, limitation of liability, indemnity, dispute resolution, and general terms.

16. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER STUDIOS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, OR FREE OF HARMFUL COMPONENTS.

YOU USE THE SERVICES AT YOUR OWN RISK.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER STUDIOS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, OR COST OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER STUDIOS’ TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO SUPER STUDIOS FOR THE SERVICES IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

18. Indemnity

You agree to indemnify and hold harmless Super Studios and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• your use of the Services;
• your User Content;
• your violation of these Terms;
• your violation of applicable law;
• your violation of another person’s rights.

19. Governing Law and Forum

These Terms and any dispute arising out of or relating to these Terms or the Services will be governed by the laws of the State of Delaware, without regard to conflict of law rules, except to the extent preempted by federal law or prohibited by applicable law.

Except as provided in the Dispute Resolution section below, the exclusive jurisdiction and venue for disputes will be the state and federal courts located in Los Angeles, California, and you and Super Studios consent to personal jurisdiction and venue in those courts.

20. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

You and Super Studios agree to first try to resolve any dispute informally. Before filing arbitration or a court proceeding, the party raising the dispute must provide written notice and allow at least 60 days for informal resolution.

You and Super Studios agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, except as described below.

You and Super Studios agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any class, representative, or consolidated action.

This arbitration agreement does not prevent either party from seeking relief in small claims court if the dispute qualifies, or from seeking injunctive or equitable relief for intellectual property infringement or misuse.

If applicable law prohibits arbitration of a particular claim or dispute, that claim or dispute may be brought in a court of competent jurisdiction.

Consumers in the European Economic Area, the United Kingdom, and similar jurisdictions. If you use the Services as a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose laws prohibit the waiver of the rights described in this section, then the agreement to arbitrate, the class-action and representative-action waiver, the choice of governing law, and the exclusive-forum provisions in these Terms apply to you only to the extent permitted by the mandatory consumer-protection laws of your country of residence. Nothing in these Terms removes the protection of those mandatory laws or your right to bring proceedings in, and under the law of, the courts of your country of residence.

The arbitration will be administered by the American Arbitration Association under its applicable rules unless the parties agree otherwise.

This section survives termination of these Terms.

21. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will provide notice as required by applicable law, which may include posting the updated Terms, providing notice in-game, or requiring you to accept the updated Terms before continuing to use the Services.

Your continued use of the Services after updated Terms become effective means you accept the updated Terms.

22. General Terms

Entire Agreement. These Terms, together with the Privacy Policy, the Community Guidelines, and any additional terms presented to you for a specific feature or at the time of a purchase, are the entire agreement between you and Super Studios regarding the Services and supersede any prior or contemporaneous agreements or understandings on that subject.

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be modified, severed from these Terms, and the remaining provisions will continue in full force and effect. In the Dispute Resolution and Arbitration section, if the class-action and representative-action waiver is found unenforceable with respect to any claim, that claim will be severed and may proceed in a court of competent jurisdiction, while all remaining claims proceed in arbitration.

Assignment. You may not assign or transfer these Terms, or any of your rights or obligations under them, without our prior written consent, and any attempted assignment in violation of this provision is void. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, financing, reorganization, or sale of assets.

No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that or any other provision in the future. Any waiver must be in writing and signed by an authorized representative of Super Studios to be effective.

Notices. We may provide notices to you through the Services, including in-game, or by sending a message to the email address associated with your Steam account or otherwise on file with us. You are responsible for keeping your contact information current. You may send notices to Super Studios at support@mastersofmayhemgame.com.

Headings. Section headings are provided for convenience only and do not affect the interpretation of these Terms.
